HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 6494 of 2002 ORDER:
This writ petition is filed seeking to issue a writ of mandamus declaring the action of the 2nd respondent in not paying interest from 01.02.1997 till actual payment on the amount payable on voluntary retirement scheme, as illegal and arbitrary.
The record discloses that the petitioner has obtained voluntary retirement on 31.12.1996 in pursuance of the voluntary retirement scheme introduced by the respondents vide circular dated 15.05.1996. As gratuity was paid to the petitioner belatedly i.e., after two years, he is seeking interest on the gratuity amount for the period of delay. Therefore, this Court is of the view that the writ petition can be disposed of directing the petitioner to submit a representation to the respondents.
Accordingly, the writ petition is disposed of directing the petitioner to submit a representation to the respondents within two weeks from the date of receipt of a copy of this order, and upon receiving such representation, the respondents shall consider the same and pass appropriate orders in four weeks thereafter.
