THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2416 OF 2016 ORDER:
This Criminal Petition is filed under Section 482 of Code of Criminal Procedure (Cr.P.C) by the petitioners-accused Nos.2 to 4 and 6 seeking to quash the proceedings in CC No.122 of 2014 on the file of Additional Judicial Magistrate of First Class, Rayachoty, for the offences punishable under Sections 323 and 325 and r/w.34 IPC. This Court perused the material available on record. A perusal of the record discloses that after completion of the investigation, the police filed charge sheet deleting the names of the petitioners. Aggrieved by the deletion of names of the petitioners, the de facto complainant filed protest petition and the Court below allowed the protest petition and after recording the sworn statement of the de facto complainant, ordered for issuance of summons to the petitioners.
It further discloses that the summons are yet to be served. In view of the facts and circumstances of the case, this Court is not inclined to grant the relief sought for by the petitioners. Accordingly, the Criminal Petition is dismissed. However, the petitioners are at liberty to file fresh application, if they so advised. Consequently, miscellaneous petitions pending if any, shall stand closed.
