THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.31463 OF 2017 O R D E R:

The writ petition is filed questioning the action of the 5th respondent in initiating proceedings under Section 145(1) Cr.P.C in M.C.No.100 of 2017 dated 11.09.2017 as illegal and arbitrary. As the petitioner challenges the notice issued under Section 145 Cr.P.C by the 5th respondent-Mandal Executive Magistrate and Tahsildar, Kalyanadurg desiring the petitioner to appear either by person or by pleader within a period of seven days from the date of receipt notice and put in a written statement of the petitioner's claim, the writ petition is not entertainable. Accordingly, the writ petition is dismissed giving liberty to the petitioner to submit his version as is pleaded before this Court. As and when such response is submitted, the 5th respondent shall consider the same and pass appropriate orders in accordance with the law. No order as to costs.

Consequently, the miscellaneous Applications, if any shall stand closed.
