Heard the learned counsel for the petitioners and Sri S.D.Goud, learned standing counsel for the respondent corporation. Notice bearing B.A.No.1012/0445/B/TIR/GN/17, U.C.No.26/2018, dated 22.09.2018, issued by the Asst.City Planner, Municipal Corporation, Tirupati under Section 452 (1) & (2) of H.M.C Act-II, 1956 is under challenge in the present writ petition.
According to the learned counsel for the petitioners, the impugned notice was served on the petitioners on 25.09.2018. He further submitted that the time granted in the said notice is insufficient and short and the petitioners herein are ready to respond to the said notice enclosing all the material in support of their case, if sufficient time is granted.
Having heard the learned counsel for the petitioners and the learned standing counsel for the respondent corporation, and to put a quietus for the issue, the Writ Petition is disposed of, leaving it open for the petitioner to file explanation with relevant material to the respondent corporation in response to the impugned notice, within one week from the date of receipt of a copy of this order, and on submitting such explanation within the stipulated time, the respondent corporation shall consider and pass appropriate orders thereon, strictly in accordance with law. Till the said exercise attains finality, no coercion action against the subject structures shall be taken. It is also open for the respondent Corporation to take photographs pertaining to the present stage of construction of the petitioners.
AVSS,J WP.34980 of 2018 The writ petition is accordingly disposed of. No order as to costs. Pending miscellaneous petitions, if any, shall stand closed in consequence.
