Heard both sides.

This Criminal Petition is filed by the petitioners/accused in Cr.No.255 of 2016 of P.S. Madhapur (Guttala), impugning the order, dt.06.05.2016 of the learned IV AJCJ-cum-XXV Metropolitan Magistrate, Cyberabad in SR No.3966 of 2016 referring the private complaint filed by the 3rd respondent/defacto-complainant to police for investigation u/sec.156(3) of Cr.P.C., alleging non-compliance of mandatory requirements of the order of the learned Magistrate in referring the private complaint for police investigation u/sec.156(3) of CrPC.

The learned Public Prosecutor for the respondents 1 and 2State submits that the police filed final report of the crime supra that was taken cognizance by the learned Magistrate allotting C.C.No.26 of 2017.

Having regard to the above, liberty is given to the petitioners to impugn said police final report by filing fresh petition with chargesheet and part-II C.D. material. The interim order dated 03.01.2017 is extended for two weeks from today. In the result, the Criminal Petition is closed.
