THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.27622 OF 2016 ORDER:

This Writ Petition is filed, under Article 226 of the Constitution of India, for the following relief: "to issue a writ in the nature of a writ of mandamus or any other appropriate writ, direction, order or orders declaring the action of the respondents 2 and 3 herein in not remove the electrical lines and poles which are highhandedly erected through the petitioner's patta lands in Sy.No.3/2C/2E admeasuring an extent of 200 cents situated at Narayanapuram, Tirupati village accounts, Tirupati Urban Mandal, Chittoor District, despite the petitioner have made several representations dt.

05-06-2015 and 04-08-2016 to the respondents authorities to request them to remove the electrical poles and shift the electrical line as wholly arbitrary, illegal and without jurisdiction and void and violated the principles of natural justice and affected the petitioner's rights guaranteed under article 14 and 21 of the Constitution of India and consequently direct the respondents to remove the electrical poles and lines from the middle of the petitioner lands in an extent of Ac.2-00 cents in Sy.No.3/2C/2E situated at Narayanapuram, Tirupati village accounts, Tirupati Urban Mandal, Chittoor District and pass such other and further order or orders as this Hon'ble Court may deems fit and proper in the circumstances of this case."

Heard Sri V.Eswaraiah Chowdary, learned counsel, appearing for the petitioner and Smt.Jagarlamudi Koteswari Devi, learned standing counsel, appearing for the respondents. 3.

When the matter is called, it is submitted by the learned counsel appearing for the petitioner that for redressal of the grievance of the petitioner, petitioner herein submitted

representations dated 05.06.2015 and 04.08.2016 and a request is made by the learned counsel for the petitioner that the said representations may be directed to be disposed of by the respondents by fixing some timeframe. The said request is not opposed by the learned standing counsel for the respondents and also submitted that appropriate orders will be passed on the said representation in accordance with law.

For the aforesaid reasons, Writ Petition is disposed of, without expressing any opinion on merits and demerits of the matter, directing the 2nd respondent to pass appropriate orders on the representations dated 05.06.2015 and 04.08.2016, said to have been submitted by the petitioner herein, within a period of eight weeks from the date of receipt of a copy of this order, in accordance with law.

5. Miscellaneous petitions pending consideration, if any, in the writ petition shall stand closed in consequence. No order as to costs.
