THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.35021 of 2018 ORDER:
When the matter is taken up, written instructions dated 19.11.2018 furnished by the Sub-Inspector of Police, Bachupalli Police Station, are placed on record by the learned Government Pleader for Home.
To the extent of their relevance to the present writ petition, the said instructions read as under:
"One Smt.Tulasi Durgamma/7th respondent herein has approached the Inspector of Police, Bachpalli Police Station and lodged a complaint on 8.9.2018 requesting to initiate action against the petitioner Mr.Sita Rama Raju as he has taken amount of Rs.5,00,000/- (five lakhs) towards sale of plot No.125 admeasuring 200 sq.yards but not returned the same and threatened to kill if she asks the same.
Upon receipt of the said complaint, an entry was made into the Station General Diary.
To know the veracity in the contents of the above complaint of the 7th respondent, this respondent police tried to contract the petitioner over phone but he did not state any facts about the transaction and ultimately filed the present writ petition.
It is humbly submitted that since the dispute of the 7th respondent Smt.Tulasi Durgamma as well as the writ petitioner herein is purely money transaction/civil in nature and hence immediately advised her to seek her redressal in a competent court of law. But as of now no action whatsoever was taken on the said complaint.
It is pertinent to submit that on coming to know the lodging of the compliant by the 7th respondent, the petitioner to prevent the police from taking any action in the event of registration of any crime against him in future, filed the present writ petition with false and frivolous allegations. It is submitted that the allegation of the petitioner that this respondent summoned him to the police station and
pressurize him to settle the civil dispute with the 7th respondent is absolutely false, baseless and hence denied. It is submitted that except enquiring the matter on the complaint of the 7th respondent herein over phone, this respondent never summoned the petitioner nor pressurized him to settle the civil disputes with the 7th respondent as alleged. It is pertinent to submit that as a precautionary measure without any cause of action, the petitioner filed the present writ petition with false and baseless allegations." On noticing the above instructions, a request is made by the learned counsel for the petitioner to place the said instructions on record and dispose of the writ petition.
Accordingly, the writ petition is disposed of by placing on record the written instructions dated 19.11.2018 furnished by the Sub-Inspector of Police, Bachupalli Police Station. There shall be no order as to costs.
Miscellaneous Petitions pending consideration, if any, in this Writ Petition shall stand closed.
