HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 35090 of 2018 ORDER:

1) Heard learned counsel for the petitioner and learned Government Pleader for Revenue. With the consent of both the parties, the writ petition is disposed of at the admission stage itself.

2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondent No.4 in issuing pattas to respondent No.5 in respect of land admeasuring Acs.2.00 in Survey No.178 and to respondent No.6 in respect of land admeasuring Acs.3.00 in Survey No.178, situated at Chindarpally Shivar, Hanwada mandal, Mahabubnagar, as illegal and arbitrary. 3) The petitioner claims to be the absolute owner and possessor of land in Survey Nos.10/A3, 11/A2, 177/4A, 179/A3 and 180/A2, admeasuring Ac.1.28 guntas, situated at Chinndarpally village, Hanwada mandal, Mahabubnagar District. It is stated that respondent No.4 handed over certificate to respondent Nos.5 and 6, without mentioning any boundaries. Thereafter, respondent Nos.5 and 6 colluded with respondent No.4, created fake certificate, made entries in the revenue records and are trying to interfere with the possession of the property of the petitioner, basing on the said fake certificate. Challenging the same, the present writ

petition is filed. It is stated that respondent No.4 has issued new pattas to the petitioner vide katha No.1422. It is the case of the petitioner that respondent No.4 has no right to issue two pattas.

4) Since the grievance of the petitioner is with regard to grant of pattas, it would be just and proper, if the petitioner take the same to the notice of the appropriate authority, in proper format, in which event, the said authority shall deal with the same, in accordance with law.

5) With the above direction, the writ petition is disposed of.
