HON'BLE SRI JUSTICE V.RAMASUBRAMANIAN AND HON'BLE SRI JUSTICE G.SHYAM PRASAD Writ Petition No.24256 of 2016 Order: (per V.Ramasubramanian, J.) Aggrieved by an order of the Andhra Pradesh Administrative Tribunal, Hyderabad, allowing his claim only for payment of salary for the period during which he worked but not confirming his appointment on compassionate grounds, the petitioner is before us.
2. Heard Mr. V.Hanumanth Rao, learned counsel for the petitioner.
3. Admittedly, the petitioner was only the grandson of the deceased Government servant.
The scheme for compassionate appointment, as pointed out by the Supreme Court repeatedly, is not intended to create a hereditary post in Government service.
Unfortunately, the Tahsildar, Kalwakurthy Mandal, appears to have overlooked the scheme for compassionate appointment and issued appointment order to the petitioner. The moment the audit objections were raised, the salary bill was stopped. Therefore, continued engagement of the petitioner lost its meaning. Hence, he approached the Tribunal. The Tribunal categorically found that the petitioner being the grandson of the deceased Government servant was not entitled to appointment on compassionate grounds, but was entitled to salary for the period during which he actually worked. Therefore, the
Tribunal granted a limited relief. Not satisfied with the limited relief, the petitioner is before us.
4. There is no dispute about the fact that the scheme for compassionate appointment does not provide for employment to grandsons. The father of the petitioner is still alive. We do not know how the Tahsildar abused his position and granted appointment. Therefore, the audit objection as well as the order of the Tribunal was perfectly in accordance with the law calling for no interference. Hence, the writ petition is dismissed. The miscellaneous petitions, if any, pending in this writ petition shall stand closed. No costs. ___________________________ V.RAMASUBRAMANIAN, J.
