HON'BLE SRI JUSTICE A. SHANKAR NARAYANA Tr.C.M.P.No.155 OF 2016 ORDER:

The present transfer petition, under Section 24 of the Code of Civil Procedure, 1908, is filed seeking to withdraw O.S.No.87 of 2009 from the file of learned XIII Additional Chief Judge (Fast Tack Court), City Civil Court, Hyderabad, and transfer the same to the file of any competent Court in the premises of City Civil Court, Hyderabad.

2. Though, a request is made on behalf of the learned counsel for petitioner for adjournment, but the case status report placed by the Registry would show that the learned XIII Additional Chief Judge, (Fast Track Court), City Civil Court, Hyderabad, reserved the said suit in O.S.No.87 of 2009 and, in fact, the learned Judge could not deliver the judgment on 07.04.2018 and postponed it to 26.04.2018. In such an event, the request made in the instant transfer petition cannot be acceded to.

3. Hence, the present transfer petition is dismissed. Miscellaneous Petitions, if any, pending in this transfer petition shall stand closed. There shall be no order as to costs. ___________________________ A. SHANKAR NARAYANA, J April 18, 2018.
