This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioner, who is arrayed as accused No.3 in Crime No.263 of 2025 of Thallada Police

Station, Khammam District, registered for the offence punishable under Section 108 of the BNS.

The brief facts of the case are that, on 15.09.2025, the de-facto complainant, who is the father of the deceased, lodged a report before the police stating that, due to the harassment of accused Nos.1 to 3, who insisted the deceased for repayment of the amount on 08.09.2025 and the deceased repaid an amount of Rs.9,00,000/- and drafted an agreement to repay the remaining balance within three months and at the time of giving MOU, accused herein along with other accused abused him in filthy language, due to which, he had committed suicide on 13.09.2025. Thereafter, he died on 14.09.2025 at 2.48 hours. Hence, he requested for necessary action. Basing on the said complaint, the police registered a case for the above said offence.

Heard Sri P. Srihari Nath, learned counsel appearing on behalf of the petitioner as well as Sri D. Arun Kumar, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioner submitted that the petitioner herein is innocent of the said allegations and there is no proximity between the incident and death of the deceased and accordingly, asking for repayment of the amount by the petitioner to the deceased does not compel the person to commit suicide. It is further submitted that the petitioner herein is ready to cooperate with the investigating authority and prayed the Court to grant pre-arrest bail to the petitioner by allowing this criminal petition. 5.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by learned counsel for petitioner, on the ground that, dying declaration of the deceased was recorded by the concerned authority, wherein, he mentioned the names of the petitioner herein and other accused Nos.1 and 2 and the custodial interrogation of the petitioner herein is required for further investigation and prayed the Court to dismiss the Criminal Petition. 6.

In the light of the submissions made by both the learned counsel and on a perusal of the material available on record, the complainant averments shows that there is a

financial transaction between the deceased and accused Nos.1 to 3 and the deceased repaid an amount of Rs.9,00,000/- and for the remaining balance, he gave an agreement stating that he will pay the same in three months and he committed suicide on 13.09.2025.

Considering the facts and circumstances of the case and also the averments in the dying declaration, the custodial interrogation of the petitioner herein is not required and this Court deems it fit to grant pre-arrest bail to the petitioner/accused No.3, subject to the following conditions:

i.

The petitioner/accused No.3 shall surrender before the Station House Officer, Thallada Police Station, Khammam District, within two weeks from today, and on such surrender, the said Station House Officer shall release him on bail on executing a personal bond for Rs.25,000/- each, with two sureties, for the like sum each.

ii.

The petitioner/accused No.3 shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, and co-operate with the Investigating Officer in investigating the case.

iii.

The petitioner/accused No.3 shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., till the filing of the charge sheet and thereafter, as and when required 7.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
