HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CIVIL REVISION PETITION No.6154 OF 2018 ORDER:

The petitioner/defendant challenges the order dated 07.06.2017 in I.A.No.218 of 2017 in O.S.No.94 of 2012 passed by learned Senior Civil Judge, Bhimavaram, allowing the petition filed by the respondent/plaintiff seeking permission of the court to pay stamp duty and penalty in respect of the documents filed by him, whose description is not given in the impugned order.

As can be seen from the impugned order, it is only a permission to respondent/plaintiff to pay the due stamp duty and penalty as per the Stamp Act. The petitioner/defendant, in the considered view of this Court, cannot raise objection as against the payment of such stamp duty and penalty payable under Stamp Act. However, the petitioner/defendant can raise the other objections if any permissible under law in respect of those documents at the time when such documents are tendered in evidence.

With the above observation, this civil revision petition is disposed of. No costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
