O R D E R

Vide the present petition, petitoner/A-2 seeks to enlarge him on bail in the event of his arrest in connection with Crime No.386/2016 on the file of Arilova Police Station, Visakhapatnam, registered for the offences punishable under Section 420 read with 34 IPC.

The petitioner/A-2 is the husband of A-1. On 9.11.2016, the learned counsel for the petitioner argued that petitioner and A-1 are living separately, due to matrimonial disputes and, therefore, he is not involved in the crime and in order to extract money, he was falsely implicated.

The learned Additional Public Prosecutor on instructions submitted that the police have made enquiries and recorded the statements of neighbours and found that the petitioner and A-1 are husband and wife. They are living together and that there are no disputes between them.

In view of the facts recorded above, the petitioner cannot claim that he is not aware of alleged criminal acts of his wife. Therefore, the present case needs custodial interrogation to unearth the true facts.
