THE HONOURABLE MR JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.2563 of 2015

ORDER

Heard learned counsel for the petitioner, learned Government Pleader for Home and learned Government Pleader for Revenue.

2. Since the grievance of the petitioner is only with regard to non-release of funds in terms of the orders passed by the Income Tax Authority, this writ petition is heard and disposed of with the following direction;

It is evident from the letter of the Deputy Director of Income Tax (Investigation), Unit-II(2), Hyderabad, dated 10.07.2014, that he has already informed the second respondent-Collector and District Magistrate that the amounts seized from the petitioner is accounted for and the seized cash, which was kept in the custody of the District Treasury of Mahabubnagar District, was requested to be released in terms of the said letter. The Collector and District Magistrate, who was also requested by the petitioner under Ex.P1letter, dated 05.08.2014, shall, therefore, take into consideration the aforesaid communication of Deputy Director of Income Tax and pass appropriate orders with regard to the seized amount expeditiously and in any case, within ten days from the date of receipt of a copy of this order.

3. With the above direction, the Writ Petition is disposed of.

There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. _______________________ VILAS V. AFZULPURKAR, J 10th February, 2015 sj
