THE HON'BLE SMT JUSTI CE KONGARA VI JAYA LAKSHMI Writ Petition No.8839 of 2013 Order:

This Writ Petition is filed to declare the action of the third respondent in issuing the eviction notice dated 21.01.2013 as illegal and arbitrary.

As seen from the impugned notice, it is clear that since the lease period of 25 years is completed, the petitioner was asked to vacate the shop as the Corporation wanted to conduct public auction. The third respondent filed its counter affidavit. Learned Standing Counsel for the third respondent submits that as there is no interim order in this Writ Petition, the subject shop was auctioned and allotted to the highest bidder and he is in possession of the same.

In that view of the matter, no orders need be passed in this Writ Petition and the same is, accordingly, closed. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
