PC: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Heard learned counsel for the contesting parties. The interim order,passed on WPMP No.14367 of 2015 in Writ Petition No.10879 of 2015, impugned in the present appeal, reads thus: "Heard both sides.
There shall be interim direction to the respondents to permit the petitioner to attend II year BDS examination, which is scheduled to be held in the month of June 2015, after collecting the examination fee from the petitioner.
Notice."
After having noticed ground Nos.3 and 4 in the grounds of appeal, we made certain suggestions to learned counsel for the parties and they have fairly stated that we need not record reasons for disposing of this appeal and they have agreed for the following order:
"If respondent No.1 appears for II year BDS examination, as per the impugned order, his result shall not be declared without leave of the learned Judge before whom the writ petition is pending. The learned Judge, in view of the peculiar facts and circumstances of the case and having considered that career of a student is at stake, is requested to hear and decide the writ petition expeditiously. It is open to the parties to file appropriate miscellaneous petition for seeking fixed date of hearing of the writ petition."
With these observations, the writ appeal is disposed of. Miscellaneous petitions, if any, also stand disposed of. _________________________ DILIP B. BHOSALE, ACJ
