O R D E R

This Criminal Petition is filed under Section 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioner/accused No.1 seeking his enlargement on bail in connection with Crime No.964 of 2025 of Jeedimetla Police Station, Cyberabad. The offences alleged

- 2 - against the petitioner are under Sections 85 and 108 of the Bharatiya Nyaya Sanhita, 2023 (BNS).

The brief facts of the case are that, on 30.09.2025, the de-facto complainant, who is the father of the deceased, lodged a report stating that in the year 2018, he performed the marriage of his daughter with the petitioner. After a few days of their marriage, his daughter and the petitioner began having frequent quarrels, as the petitioner used to remain idle at home, consume alcohol, and harass his daughter both mentally and physically, while she continued to work. On 29.09.2025, when his daughter asked the petitioner to go to work, warning that otherwise she would commit suicide, the petitioner replied that he would not work and told her to die. Consequently, his daughter committed suicide by hanging herself from the ceiling fan hook and died. Based on the complaint, the police registered a case for the aforementioned offences.

Heard Ms. A. Bhagya Lakshmi, learned counsel representing Sri M. Keshav Yadav, learned counsel appearing for the petitioner and Sri D. Arun Kumar, learned Additional Public Prosecutor appearing for the respondent-State.

The contention of learned counsel for the petitioner is that the petitioner is innocent of the alleged offences and has been falsely implicated in the case and that the petitioner was arrested on 30.09.2025 and has been in judicial custody since 01.10.2025 and that the material part of the investigation has already been completed. At the time of alleged incident by the deceased, the petitioner is not in the house and he was falsely implicated in this case. Therefore, he prayed this Court to grant bail to the petitioner.

On the other hand, the learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner, contending that the allegations against the petitioner are grave in nature and that the investigation is still in progress and the charge sheet is yet to be filed. Therefore, he prayed the Court to dismiss the criminal petition.

In light of the submissions made by both the learned counsel and upon a perusal of the material available on record, it is evident that the petitioner has been in judicial custody since 01.10.2025. As recorded in the remand case diary, the prosecution witnesses LWs.1 to 13, including the

- 4 - investigating officer, had already been examined. Considering the overall facts and circumstances of the case, including the nature of the allegations, the stage of investigation, and the duration of incarceration, this Court finds it appropriate to grant bail to the petitioner-accused No.1, subject to the following conditions:

i.

The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of the learned VIII Additional Metropolitan Magistrate, Medchal.

ii.

The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous petitions, if any, pending shall stand closed.
