Petitioner is presently working as Senior Assistant and claiming promotion as Office Superintendent. Though he was earlier due for promotion, he was ignored and his juniors were promoted. Disciplinary action initiated against the petitioner resulted in imposing punishment of withholding of two annual increments with cumulative effect. Criminal prosecution was launched against the petitioner under the Prevention of Corruption Act. Petitioner is accused No.1 in C.C.No.08 of 2011 on the file of Special Judge For S.P.E. & A.C.B. Cases, Vijayawada. 3.
Since a criminal case is pending against the petitioner no direction can be granted to promote the petitioner or consideration for promotion even against the non-selection post, when allegations are pending against him.

Government issued orders in G.O.Ms.No.257 dated 10.06.1999 for consideration of claims for promotion. If there is delay in disposal of criminal/departmental proceedings, subject to fulfilment of parameters set out in the said G.O, his case may be considered for promotion in terms thereof.

With the above observations, the writ petition is disposed of. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
