When the matter is taken up for hearing, learned counsel for the petitioner seeks permission of this Court to withdraw the writ petition with a liberty to approach the Cooperative Tribunal challenging the surcharge proceedings.

In view of the above said submission, this writ petition is dismissed as withdrawn giving liberty to the petitioner to approach Cooperative Tribunal. No order as to costs.

Pending miscellaneous applications, if any, shall stand closed in consequence.
