THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.22164 of 2016 ORDER:
This writ petition is filed under Article 226 of Constitution of India seeking a writ of mandamus directing the respondents not to acquire the land of petitioners without following due process of law.
2. The contention of learned counsel for the petitioners is that the Government has acquired land in survey No.113 of Garepalli village of Kataram Mandal in Karimnagar District for construction of pipeline to Kaleshwaram Muktheshwara Lift Scheme and Sripadasagar Ellampalli Project. He further submitted that the petitioners owned an extent of Acs.3.00 of land in survey No.113 of Garepalli village and the respondents are trying to interfere with the peaceful possession and enjoyment of the land by the petitioners.
3. The apprehension of the petitioners is that the Government may dig their land for the purpose of laying pipeline without issuing any notification to acquire the land.
4. The learned Assistant Government Pleader for Irrigation and Command Area Development (TG) submitted that the Government has acquired Ac.0.10 guntas of land belongs to Thota Venkata Swamy situated in survey No.113 of Garepalli village. The learned Assistant Government Pleader has further submitted that the respondents are not going to dig the land of the petitioners without following due process of law.
5. Having regard to the facts and circumstances of the case, the respondents are hereby directed not to take possession of the petitioners' land in an extent of Acs.3.00 in survey No.113 of Garepalli village of Kataram Mandal in Karimnagar District, without following due process of law.
6. With the above direction, the writ petition is disposed of.
Miscellaneous petitions, if any pending in this writ petition, shall stand closed.
