THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4934 OF 2016 ORDER:

This petition is filed by the petitioners-accused Nos.1 to 4 under Section 482 Cr.P.C. seeking to quash the proceedings against them in FIR No.57 of 2016 on the file of the Mangalhat Police Station, Hyderabad, registered for the offence punishable under Sections 307, 341, 506 r/w 34 IPC and Section 25((1)(A) of the Arms Act. Heard and perused the material available on record. The petitioners approached this Court on the ground that the petitioners and accused entered into compromise and therefore, the proceedings may be quashed. The learned Counsel for the petitioners informed that petitioners Nos.1, 3 and 4 are still in prison. In the circumstances of the case, this Court is of the view that the alleged offences cannot be compounded at this stage. Therefore, this petition is liable to be dismissed.

Accordingly, the Criminal Petition is dismissed. However, the petitioners Nos.1, 3 and 4 are at liberty to approach the Court concerned for bail basing on the memorandum of compromise entered into between the parties. All the petitioners can approach this Court after release of petitioners Nos.1, 3 and 4 on bail.
