Gade Ashok Reddy v. Anusha Reddy Singareddy
THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRL.P.NO.7962 OF 2016
O R D E R
The petitioner is husband of respondent No.1 and owing to the alleged disputes, they are living separately. The respondent - wife filed M.C.No.77 of 2015 on the file of Judge, Family court - cum - III Additional District Judge, Warangal, against the petitioner - husband seeking maintenance and pending the main case, filed Crl.M.P.No.40 of 2015 in M.C.No.77 of 2015 seeking interim maintenance and the trial court by the impugned order and decree dated 22.2.2016 directed the petitioner to pay an amount of Rs.7,000/- per month towards interim maintenance to the 1st respondent. Aggrieved by the same, the present petition.
Heard the learned counsel for the petitioner and the Public Prosecutor (Telangana) appearing for the state.
A perusal of the impugned order goes to show that the trial court based on evidence and as the petitioner is working as Software Engineer in USA, passed the impugned order granting interim maintenance at the rate of Rs.7,000/- per month to the 1st respondent, which in my considered view, is just and reasonable and cannot be said to be exorbitant. Hence, I do not find any ground to interfere with the impugned order and the criminal petition is liable to be dismissed and accordingly dismissed. No costs.
Miscellaneous petitions pending if any, shall stand closed. ---------------------------- M.S.K.JAISWAL,J DATE:10.09.2016 AVS
