THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.23056 of 2015 ORDER:

The petitioner was appointed as a fair price shop dealer of Rangapuram Village, Narpala Mandal in Ananthapuram District. While so, the Deputy Tahsildar, Enforcement, Ananthapuram, submitted a report on 22.06.2015 to the second respondent, based on which a show cause notice was issued to the petitioner alleging variation of 5.20 quintals of PDS rice. The petitioner submitted her explanation on

30.06.2015 and after receipt of the same, the authorisation of the petitioner was suspended by the second respondent by order dated 07.07.2015. Challenging the same, the present Writ Petition is filed. This Court perused the order passed by the second respondent on 07.07.2015 suspending the authorisation of the petitioner after receipt of the explanation. Though this Court is not satisfied with the manner of passing the order after considering the explanation submitted by the petitioner, in view of the pendency of the enquiry, this Court is not inclined to interfere with the enquiry process at this stage. The second respondent is directed to complete the enquiry and pass a reasoned order after giving due opportunity to the petitioner, within a period of thirty days from the date of receipt of a copy of this order. The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
