HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P.No.617 of 2013 ORDER:

This petition is filed to withdraw marriage O.P.No.61 of 2012 from the file of Senior Civil Judge, Mahabubnagar, and transfer the same to Family Court, Ranga Reddy.

2. Petitioner-wife filed this petition and according to her affidavit, her marriage was performed with respondenthusband on 26.03.2008 at Champapet, Hyderabad, and she lived with her husband for one year happily and due to harassment and humiliation, she went back to her parent's house and lodged a complaint before Women Police Station, Saroornagar, which is registered as Crime No.39 of 2010 pending before XIV Metropolitan Magistrate Court, L.B.Nagar, and later the same is settled before Lok Adalat and again as he started harassment, she filed D.V.C.No.20 of 2013 before XI Metropolitan Magistrate and the same is pending. She further stated that husband filed O.P.No.61 of 2012 for dissolution of marriage and it is difficult for her to attend Mahabubnagar Court for the purpose of defending O.P.No.61 of 2012, as she is a unemployee and that she has no earnings to meet the travelling expenses. Therefore, she prayed for transfer of O.P.No.61 of from Senior Civil Judge, Mahabubnagar to Family Court, Ranga Reddy.

3. Respondent-husband has not filed any counter disputing the affidavit averments of petitioner.

4. Heard both sides.

5. I have perused the material papers filed along with transfer C.M.P. As seen from the material, D.V.C. filed by petitioner is pending before XI Metropolitan Magistrate and respondent herein is attending the said Court in connection of that case.

Therefore, considering the convenience of wife and the fact that respondent is already attending Ranga Reddy Court in connection of D.V.C., I feel that the request of wife can be considered.

6. For these reasons, O.P.No.61 of 2012 is withdrawn from Senior Civil Judge, Mahabubnagar, and transferred to Family Court, Ranga Reddy, for disposal in accordance with law.

7. Accordingly, transfer C.M.P. is ordered. No costs.

8. Miscellaneous Petitions pending, if any, shall stand dismissed.
