THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO Crl.P.M.P.No.16699 of 2014 in Crl.P.No.8645 of 2013 and Crl.P.No.8645 of 2013 Common Order:

The de facto complainant and her counsel Sri G.L.Nageswar Rao are present. Accused and their counsel Sri M.Amarnath are present.

Heard both sides and perused the petition.

The Police of Malkajgiri P.S have filed charge sheet in FIR No.527 of 2012 against the accused for the offences under Section 498-A IPC r/w Sec. 3 and 4 of Dowry Prohibition Act and the learned X Metropolitan Magistrate, at Malkajgiri, Cyberabad took cognizance of the same and registered in C.C.No.442 of 2013. Now the submission of both sides is that at the intervention of elders, both parties have amicably resolved their disputes and the de facto complainant and petitioner/A.1 decided to live together and therefore, permission may be accorded to them to enter into compromise and quash the proceedings in C.C.No.442 of 2013 on the file of X Metropolitan Magistrate, at Malkajgiri, Cyberabad in the interest of justice.

Having regard to the above submission and considering the fact that it is a matrimonial matter wherein

the parties have amicably settled their disputes and proposing to live together and considering that no useful purpose will be served even if the parties are driven to trial since they compromised and following the decision reported in Gian Singh v. State of Punjab and another[1], permission is accorded and this Criminal Miscellaneous Petition is allowed and compromise is recorded and consequently the proceedings in C.C.No.442 of 2013 on the file of X Metropolitan Magistrate, at Malkajgiri, Cyberabad are hereby quashed. In the result, both the petitions are accordingly disposed of.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
