HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION NO. 1900 OF 2015 ORDER:
Heard.
It is informed that bail order condition directing the petitioners/A2 & A4 to appear before the Judicial Magistrate of First Class, Rajampet, on every working Saturday till such time A1 apprehended or surrendered before the Court, is causing any amount of hardship because they are women and A2 is a aged lady and A4 is a house wife residing at Ameerpet, Hyderabad. It is also informed that A1 is residing at Kuwait, till now is neither apprehended nor surrendered before the Court.
In view of above submission, investigating agency may follow an appropriate legal procedure for apprehension of A1, however, petitioners/A2 & A4 cannot be compelled to attend on every Saturday till A1 is either apprehended or surrendered, which condition, in my view, will cause any amount of hardship to them. Therefore, the said condition is relaxed. The other conditions passed in the bail order shall hold good. Accordingly, the Criminal Petition is disposed of. As a sequel thereto, miscellaneous petitions, pending if any, shall stand closed.
