Heard learned counsel for the petitioners and also the learned public prosecutor, representing the State. 2.

In continuation to the docket order dated 04.09.2017 in ordering after elaborate hearing from the submission of Crl.P.No.9005 of 2013 also stated pending to list along with this, it discloses that the said petition is withdrawn. 3.

Having regard to the above, from what is observed supra, basically there is nothing to recall. Almost all witnesses among P.Ws.1 to 7 asked but for P.W.5 at the fag end including from the unsustainable ground of change of advocate to ask for some more questions but for to permit to the further cross-examination by recall of P.W.1 and the Investigation Officer for any material omissions and contradictions to be also put to Investigation Officer and subject to costs of Rs.5,000/- and subject to condition of giving in a sealed cover to the court what are the relevant questions on omissions or contradictions to be put to the witness and Investigation Officer, within one week from the date of receipt of the order, for the lower court so to permit and the imposed costs of Rs.5,000/- to be deposited before the Superintendent of the trial court in the meantime to pay to the P.W.1.

Accordingly, this criminal petition is allowed with the above directions.

Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence.
