Heard learned counsel for the petitioner and learned counsel for the respondents.
The petitioner claims to have purchased house plots in a layout approved by the Abdullahpur Gram Panchayat. It is the grievance of the petitioner that the respondents are contemplating to dispossess her without following the due process of law.
The averments in the affidavit are that the petitioner purchased plot No.132, admeasuring 200 Sq.Yds., in Sy.No.283/65, situated at Abdullahpur village, Hayathnagar Mandal, Ranga Reddy District, under registered sale deed No.6623/2002 dated 14-10-2002 from C.Pochaiah. The vendor of the petitioner converted the agricultural land into house plot after obtaining necessary permission from Abdullahpur Gram Panchayat vide permission dated 23-121995. While so, the Tahasildar, Hayathnagar Mandal, Ranga Reddy District - respondent No.3 started interfering with the possession of the petitioner on the ground that the land in possession of the petitioner is an assigned land and the same is required for 'Indiramma Pathakam'.
Learned counsel for the petitioner submits that the issue involved in this petition is squarely covered by the common order, dated 05.10.2012, passed in W.P.No.18986 of 2010 and batch. Following the said order, this Writ Petition is allowed directing the respondents not to interfere with the plot in occupation of the writ petitioner till the fresh resumption orders to the extent of the writ petitioner are passed after putting them on notice under the provisions of the Andhra Pradesh Assigned Lands (Prohibition of Transfers) Rules, 1977. No
costs.
Consequently, miscellaneous petitions, if any, pending in this writ petition shall stand closed.
