THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL REVISION CASE NO.2650 OF 2016 ORDER:

This Criminal Revision Case is filed under Sections 397 and 401 Cr.P.C. challenging the docket order, dated 16.05.2016 in Crl.M.P.No.2936 of 2015 in C.C.No.95 of 2016 on the file of the Judl. Magistrate of I Class, Kodangal, Mahaboobnagar District. 2.

Heard the learned counsel for the petitioner and the learned Special Assistant Public Prosecutor, representing the State.

A perusal of the record reveals that the petitioner herein filed the above Crl.M.P. under Section 451 Cr.P.C. for release of the lorry bearing No.AP 24 Y 7384. The trial Court allowed the said petition on 09.12.2015 by imposing some conditions. As the petitioner failed to comply with the conditions imposed by the trial Court, the trial Court cancelled the order, dated 09.12.2015 on 16.05.2016. Hence, this revision. 4.

The trial Court already released the vehicle. Even if the order passed by the trial Court, dated 16.05.2016 is set aside, no prejudice will be caused to the respondent. 5.

Having regard to the facts and circumstances of the case, the Criminal Revision Case is allowed setting aside the order of the trial Court, dated 16.05.2016. However, the order passed by the trial Court in Crl.M.P.No.2936 of 2015 in Cr.No.144 of 2015, dated 09.12.2015 stands restored.

Miscellaneous petitions, if any pending, in this revision shall stand closed.
