THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.32203 of 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a writ of Mandamus declaring the inaction on the part of the second respondent in considering the representation of the petitioner dated 15.09.2016, as illegal and arbitrary.

Heard Sri Vedula Venkata Ramana, the learned senior counsel appearing for the petitioner, the learned Government Pleader for Panchayat Raj and Rural Development appearing for respondent No.1, Sri G.Narender Reddy, the learned Standing Counsel for Gram Panchayat appearing for respondent No.2, and the learned Government Pleader for Revenue appearing for respondent Nos.3 and 4.

A perusal of the record reveals that the petitioner established Paperboards Manufacturing Unit at Sarapaka Village of Burgampahad Mandal, Khammam District in the year 1976. After obtaining permission from the competent authorities, the petitioner laid pipeline for discharge of effluent. Due to passage of time, the pipeline became corrosion. The apprehension of the petitioner is that there is every possibility for damage to the pipeline. The technical experts advised the petitioner to replace the pipeline in the interest of the petitioner as well as the public at large. The petitioner submitted a representation to the second respondent to take necessary action to evict the persons, who have constructed the temporary houses on the pipeline.

At the time of arguments, the only relief sought for by the learned counsel for the petitioner is to direct the second respondent to dispose of the representation of the petitioner dated 15.09.2016 as expeditiously as possible. The learned Standing Counsel also consented for the same.

Having regard to the facts and circumstances of the case and also the submissions made by the learned counsel for both parties, the second respondent is hereby directed to dispose of the representation of the petitioner dated 15.09.2016 in accordance with law as expeditiously as possible.

With the above direction, the Writ Petition is disposed of. No costs.

Consequently, Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
