THE HON'BLE SRI JUSTICE RAJA ELANGO Transfer Criminal Petition No.104 of 2016 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking to transfer C.C.No.13 of 2013 on the file of Principal Special Judge for CBI Cases, Hyderabad to any other CBI Court in Hyderabad dealing with ACB matters at Kurnool.

Heard the learned counsel for the petitioner/Accused and the learned Public Prosecutor and perused the material on record. After arguing for some time, the learned counsel for the petitioners fairly stated that C.C.No.13 of 2013 was posted for arguments today i.e. 06.04.2016 and by 11.00 A.M. it was passed over for submitting his arguments and he requested that the trial Court may be directed to hear the arguments on some other date except on 0604-2016 because he is present before this Court and he has to make his submissions after perusal of the entire case. Considering the said request of the learned counsel for the petitioners, the Court is of the view that the petitioner can be given an opportunity to make his submissions before the trial Court on 20-042016. However, it is made clear that if the petitioners fail to place his arguments on 20-04-2016, the trial Court is at liberty to proceed further in accordance with law.

Subject to the above direction, the criminal petition is disposed of. Consequently, miscellaneous petitions pending, if any, shall stand closed.
