HON'BLE SRI JUSTICE R. SUBHASH REDDY AND HON'BLE SRI JUSTICE A. SHANKAR NARAYANA WRIT PETITION No.33149 OF 2015 ORDER: (Per Hon'ble Sri Justice R. Subhash Reddy) This Writ Petition is filed seeking Writ of Mandamus to declare the order, dated 29.11.2013, in C.C. No.533 of 2013 passed by respondent No.2, the District Consumer Disputes Redressal Forum - I, Hyderabad, as illegal and arbitrary and to set aside the same. 2 . Against the impugned order, the petitioner has already preferred an appeal before respondent No.1, Telangana State Consumer Disputes Redressal Commissioner, Hyderabad (for short 'State Commission'), but, as there was no President, the State Commission was not functioning, as such, during the month of October 2015, this writ petition is filed by the petitioner and this Court while ordering notice before admission on 07-10-2015, granted interim stay.

3 . While so, when the matter is taken up for hearing, it is submitted that President to the State Commission is appointed and is functioning.

4. As much as the petitioner has already preferred an appeal against the order impugned before the State Commission, it is at liberty to pursue the said appeal and it is open for the State

Commission to pass appropriate orders on merits. However, it is directed that the interim stay, dated 07-10-2015, granted by this Court shall remain in force for a period of four (4) weeks from today.

5. With the directions as above, the Writ Petition is disposed of. There shall be no order as to costs. 6 . As a sequel thereto, Miscellaneous Applications, if any, pending in this writ petition stand disposed of. __________________________ R. SUBHASH REDDY, J __________________________ A.
