THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION NO.639 of 2015 ORDER:
Upon hearing both sides, the Criminal Petition is disposed of at the admission stage with the following Order: A perusal of the FIR allegations shows that in the matter of execution of sale deed in favour of the complainant, the petitioner/Accused No.2 as G.P.A. Holder of Accused No.1, executed the said deed and it is the allegation of the complainant that without informing about the encumbrances in respect of the property in favour of S.B.H., Indrapalem, Kakinada, East Godavari District, the petitioners/A.2 and A.3 along with A.1 cheated her. In view of the prima facie accusation against the petitioners/A.2 and A.3 and also A.1, it is not a fit case to quash the proceedings. However, considering the submission of learned counsel for petitioners/A.2 and A.3 that A.2 is a woman and A.3 is the husband of A.
2 and they have nothing to do with the offence and they were mislead by A.1, the Police of Indrapalem Police Station, Kakinada, East Godavari, are directed not to arrest the petitioners/A.2 and A.3 during the course of investigation. The police are directed to complete the investigation at the earliest. The petitioners/Accused Nos. 2 and 3 are directed to cooperate with the investigating agency for smooth completion of investigation.
As a sequel, miscellaneous petitions, if any, pending shall stand closed.
