HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION NO. 1956 OF 2017 ORDER:
Petitioner is a native of Rajahmundry Rural. The disciplinary action was initiated against him when he was working in Adilabad. He was removed from service by the Director General and Inspector General of Prisons and Director of Correctional Services in the service of united State of Andhra Pradesh. Criminal proceedings were lodged against him in Rajahmundry. Petitioner now seeks to review the order of his removal on the ground that he was subsequently acquitted.
Since the petitioner is a native of Rajahmundry and acquittal was granted in Rajahmundry, he has to invoke the jurisdiction of Administrative Tribunal constituted under the Administrative Tribunal Act, 1985. Even otherwise, when claim concerns two States, the jurisdiction still vests with the Administrative Tribunal. Granting liberty to the petitioner to avail remedy under the Administrative Tribunal Act, this Writ Petition is dismissed. There shall be no order as to costs.
