The case of the petitioners is they have purchased the pieces of land. While so, the respondents issued a notice dated 20.03.2007 to the neighbouring land owners under Section 3(2) of Andhra Pradesh Assigned Lands (Prohibition of Transfers) Act, 1977 (for short 'the Act'). Though, the petitioners have not received any such notices at any point of time, the respondents are taking measurements of the lands and are trying to dispossess the petitioners. Aggrieved by the same, the present writ petition is filed.
Counter affidavit is filed by the 4th respondent stating that notice in Form-I & II were issued on 27.03.2007 and the resumption orders were passed on 18.05.2007 by the Tahsildar, Bapatla and the lands were duly taken possession by the department under cover of panchanama on 25.07.2007 and distributed the same to the eligible land less poor. No reply affidavit is filed disputing the same. In view of the above facts and circumstances, no relief can be granted and accordingly, the writ petition is dismissed. However, it is open for the petitioners to challenge the resumption orders. No costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. ____________________________ A.RAJASHEKER REDDY, J 24.11.2016 dv
