THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI CIVIL REVISION PETITION No.5725 of 2011 ORDER:

The grievance of the writ petitioners is that the interlocutory application in IA.No.61 of 2011 in OS.No.2135 of 2008 on the file of the Court of the learned IV Senior Civil Judge, City Civil Court at Hyderabad filed for setting aside the ex parte decree and another interlocutory application in IA.No.62 of 2011, which was filed for condonation of delay of 306 days in seeking to set aside the ex parte decree are not being disposed of by the Court below.

At the hearing, the learned counsel for the parties would submit that ends of justice would be met if the revision petition is disposed of with a direction to the Court below to dispose of in the first instance IA.No.62 of 2011 in strict accordance with the procedure established by law and on merits.

Recording the aforesaid submission, the Civil Revision Petition is disposed of directing the Court below to dispose of IA.No.62 of 2011 in OS.No.2135 of 2008 on merits and in strict accordance with the procedure established by law as expeditiously as possible and at any rate not later than a period of one (01) month from the date of the receipt of a copy of this order. There shall be no order as to costs.

Miscellaneous petitions pending, if any, in this CRP shall stand closed.
