THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 8142 of 2011 ORDER:- Heard learned counsel for the petitioner and learned Government Pleader for Revenue appearing for the respondents 2 to 7.

The present writ petition is filed seeking issuance of a writ of mandamus to declare the action of the respondents 2 to 7 in not taking any action against the 1st respondent as illegal and arbitrary.

The averments made in the affidavit filed in support of the writ petition are that the petitioner is the owner of land admeasuring Ac.1.65 cents situated in Survey No.157 of Narnepadu Village, Muppalla Mandal, Guntur District, and the 4th respondent granted a pattadar passbook in her favour vide patta No.1132G 666077. It is stated that the petitioner has been paying the cist for the said land regularly. While things stood thus, the 1st respondent, who is none other than the son of the petitioner, along with his agents started interfering with the peaceful possession and enjoyment of the petitioner over the land. Hence, the present writ petition questioning the inaction on the part of the respondents 2 to 7 against the 1st respondent. At the time when the matter is taken up for admission, the learned counsel for the petitioner submits that the 1st respondent died on 12.03.2012. That being the position, the

question of directing the respondents 2 to 7 to take action against the 1st respondent would not arise. If the petitioner has any grievance with regard to the interference by any of the legal heirs of the 1st respondent, she can avail the remedies available under law.

With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.

Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed.
