CVNR,J & GSP,J Crl.A.No.923 of 2013 JUDGMENT: (Per the Hon'ble Sri Justice C.V.Nagarjuna Reddy) This appeal is filed by accused Nos.2 and 3 in Sessions Case No.134 of 2011 on the file of learned III Additional District & Sessions Judge (Fast Track Court), Medak, assailing the judgment, dated 14.05.2013, in the aforesaid Sessions Case. 2.

Today, at the hearing, Mr.K.V.R.Prasad, learned counsel representing Mr.M.Vijaya Kanth, learned counsel for the appellants, has submitted that due to miscommunication, he ventured to file the present appeal on behalf of the appellants; that subsequently, he came to know that even before filing of this appeal, the appellants along with accused No.1 i.e., Bartholla Raju approached another counsel to file appeal, which was filed and the same was registered as Criminal Appeal No.434 of 2013 and that the said appeal has also been listed today for considering grant of bail to the appellants therein, including the appellants herein.

On verification of the cause title of Criminal Appeal No.434 of 2013, we find the above submissions of the learned counsel appearing for the appellants as correct. As the appellants have already filed Criminal Appeal No.434 of 2013, which is pending before this Court, the present appeal is unnecessary.

Accordingly, as requested by the learned counsel appearing for the appellants, this Criminal Appeal is dismissed as withdrawn, without

CVNR,J & GSP,J Crl.A.No.923 of 2013 prejudice to the rights of the appellants to pursue Criminal Appeal No.434 of 2013.
