This criminal petition is filed under Sections 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioners/accused Nos.1 and 2 seeking enlargement on bail in Crime No.599 of 2025 of Armoor Police Station, Nizamabad District, registered for the offences
punishable under Sections 318(4), 111(1) r/w 3(5) of the BNS and Section 7 of the EC Act.

The case of the prosecution is that, accused No.1 found with PDS rice, while transporting the same in his TATA Magic goods carrier vehicle to Dharmabad of Maharashtra State and on enquiry, he informed that the same was purchased from accused No.2, who is the Fair Price Shop dealer of Velpoor village and 7.60 quintals of PDS rice was seized from the possession of accused No.1 and registered a case for the above said offences and as there are previous similar offences against accused No.1, Section 111 of the BNS is also included. 3.
Heard Sri Alluri Divakar Reddy, learned counsel for the petitioners and Sri D. Arun Kumar, learned Additional Public Prosecutor appearing for the respondent-State. 4.
Learned counsel for the petitioners submitted that the alleged offences against the petitioners are punishable below seven (07) years and Section 111 of the BNS is not applicable to petitioner No.2/accused No.2 and there are no such offences alleged against petitioners/accused Nos.1 and 2 and the PDS rice was seized from the possession of petitioner
No.1/accused No.1 and they are in jail since 10.11.2025 and the material part of the investigation was already completed and prayed the Court to grant bail to the petitioners by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioners stating that the allegations against the petitioners are serious in nature and petitioner No.1/accused No.1 is the habitual offender and previously, he is involved in two other cases and prayed to dismiss this petition.

Having regard to the submissions made by both the learned counsel and the material on record, petitioner No.1/accused No.1 previously also involved in two similar offences and this is a third offence and he was found with PDS rice and therefore, petitioner No.1/accused No.1 is not entitled for the bail and on the other hand, petitioner No.2/accused No.2 is the Fair Price Shop Dealer and there are no other case pending against him and Section 111 of the BNS is not applicable to Petitioner No.2/accused No.2. Considering the facts and circumstances of the case and the period of incarceration of petitioner No.2/accused No.2 in jail, this
Court deems it fit to grant bail to the petitioner No.2/accused No.2 subject to the following conditions:
i.
The petitioner No.2/accused No.2 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of learned Principal Judicial First Class Magistrate, at Armoor.
ii.
The petitioner No.2/accused No.2 shall appear before the concerned SHO at 11:00 a.m., on every Wednesday for a period of eight
(8) weeks, for the purpose of investigation and thereafter, as and when required.
iii.
The petitioner No.2/accused No.2 shall abide by the conditions stipulated in Section 483(2) of BNSS.

Accordingly, this Criminal Petition is partly allowed and this Criminal Petition is dismissed against petitioner No.1/accused No.1.
Miscellaneous applications, if any pending, shall stand closed.
