THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.6771 OF 2016 ORDER:

This Criminal Petition is filed by A.1 seeking to quash the proceedings in C.C.No.137 of 2016 on the file of IX Metropolitan Magistrate, Kukatpally at Miyapur for the offence under Sections 498-A IPC and Sections 3 & 4 of Dowry Prohibition Act. Heard and perused the material on record.

After arguing for some time, since this Court is not inclined to quash the impugned proceedings at the threshold, the learned counsel for the petitioner submitted that Non-Bailable Warrants and look-out notice are pending against the petitioner and prayed to recall the warrants issued by the trial Court against the petitioner.

In the circumstances, the petitioner is directed to surrender before the Court below on or before 30th June, 2016 and file an application seeking to recall the warrants and look-out notice. On filing such application, the Court below is directed to recall the Warrants and look-out notice issued against the petitioner on the same day on condition of petitioner executing a personal bond for a sum of Rs.10,000/- with one surety for the likesum for his future appearance. Till then, the operation of the look out notice and the warrants issued against the petitioner is suspended. The Criminal Petition is accordingly disposed of.
