HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 35752 of 2018 ORDER:

1) Heard learned counsel for the petitioner and learned Government Pleader for Revenue. With the consent of both the parties, the writ petition is disposed of at the admission stage itself. 2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondent No.3 in not passing order against the stay petition dated 05.09.2018, filed by the petitioner, as illegal and arbitrary.

3) At the time when the matter is taken up for hearing, learned counsel for the petitioner would submit that though the petitioner preferred an appeal along with stay application against the orders of the Tahsildar, dated 28.06.2018, till date, no orders are passed in the stay application. 4) Having regard to the above, the writ petition is disposed of directing the Revenue Divisional Officer - respondent No.4, before whom the appeal is pending, to pass orders in the stay application, as early as possible, preferably within a period of three to four weeks from today. 5) Miscellaneous petitions, pending if any, shall stand closed in the light of this final order.
