THE COURT MADE THE FOLLOWING:

ORDER:

This writ petition is filed for the following substantive relief: "...to issue a writ, order or direction, more particularly one in the nature of Writ of Mandamus declaring the action of the respondent No.2 & 3 in not considering the claim of the petitioners for appointment as FP Shop dealers of Shop No.288; Shop No.91; Shop No.259 of Visakhapatnam City as LRs of deceased dealers and trying to appoint fresh candidates even though issue is pending by virtue of G.O. Ms. No.20, dt.17.8.2011 as illegal, arbitrary and violative of principles of natural justice and consequently direct the respondents to appoint petitioners as fair price shop dealers in respect of Shop No.288; Shop No.91; Shop No.259 of Visakhapatnam City." At the hearing, Mr. G. Ratnakumar, learned counsel representing Mr. Kowturu Vinaya Kumar, learned counsel for the petitioner, submitted that the cause in the writ petition does not survive for adjudication.

In view of the above submission, the writ petition is dismissed as infructuous.

As a sequel to dismissal of the writ petition, interim order dt.08.6.2012 shall stand vacated and W.P.M.P. No.21512 of 2012 shall stand dismissed.
