HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4761 of 2015 ORDER:

This Criminal Petition, under Section 482 Cr.P.C., is filed by the petitioner - A2 to relax the condition imposed in Crl.M.P. No.1008 of 2015, dated 16.03.2015, by the II Additional Metropolitan Sessions Judge, Hyderabad.

The petitioner is A2 in Crime No.1127 of 2014 of Panjagutta Police Station, Hyderabad registered for the offences under Sections 406, 420 and 468 read with 34 IPC. He filed Crl.M.P.No.589 of 2015 before the II Additional Metropolitan Sessions Judge, Hyderabad, seeking grant of anticipatory bail. The learned Sessions Judge granted anticipatory bail on conditions of the petitioner executing a bond for Rs.25,000/- with two sureties for the likesum to the satisfaction of the Station House Officer concerned, and also the petitioner shall report before Station House Officer concerned, on every Sunday and Wednesday between 11.00 a.m. to 3.00 p.m. till the end of June, 2015 or filing of charge sheet, whichever is earlier. The petitioner complied with the said conditions and thereafter, he filed Crl.M.P. No.

589 of 2015 before the Court below to modify the condition of reporting before the SHO, twice in a week. The Court below partly allowed the said petition and modified the condition of attending on every Sunday and Wednesday to every Sunday. Aggrieved by the said order, the present petition is filed.

Heard and perused the material available on record. A perusal of the order passed by the Court below in Crl.M.P. No.589 of 2015 discloses that the condition of attending before the Station House Officer, concerned is twice in a week till the end of June, 2015 and the same was also modified by the Court below to

once in a week i.e. on Sunday through the impugned order. There are only two weeks left to the petitioner to appear before the concerned SHO. Therefore, this Court is not inclined to interfere with the order passed by the Court below.

Accordingly, the Criminal Petition is dismissed. ______________ RAJA ELANGO, J June 16, 2015.
