THE HON'BLE DR. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION Nos.9262 AND 9234 OF 2017 COMMON ORDER:
The petitioners are A1 and A2 respectively of Crime No.240 of 2017 of P.S.Yadagirigutta, Rachakonda District, registered for the offences punishable under sections 323 and 506 IPC and Section 3(1)(s) of SC/ST POA Amended Act.

Heard learned counsel for the petitioners and also the learned public prosecutor, representing the 1st respondent - State, before ordering notice to the 2nd respondent - defacto complainant and perused the common grounds urged in the respective quash petitions and also the common contentions therein. 3.
From the above, there is nothing to entertain, much less to interdict the investigation but for to left open all available defenses and if at all in the event of any necessity of arrest of the petitioner, the police shall strictly follow Section 41A of Cr.P.C. and the guidelines laid down by the Hon'ble Apex Court in Arnesh Kumar Vs. State of Bihar1.

Accordingly and with the above observations, these criminal petitions are disposed of. Miscellaneous petitions pending consideration, if any, in these cases shall stand closed in consequence.
