HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.11091 of 2015 ORDER:

This criminal petition, under section 438 of the Code of Criminal Procedure, is filed by the petitioner-Accused seeking to grant bail in Crime No.462 of 2015 of Kancharapalem Police Station, Visakhapatnam, registered for the offences punishable under Sections 307, 323 and 506 r/w.34 IPC. Heard and perused the material available on record. The allegation against the petitioner is that he along with two other persons, assaulted the de facto complainant without there being any reason. Learned counsel for the petitioner submitted that the petitioner is innocent of the offences alleged against him and he was falsely implicated in the case and there is delay in lodging the complaint.

Learned Public Prosecutor informed this Court that there is another case pending against the petitioner, in which the offences alleged are so serious in nature.

Taking into consideration the gravity of the offences alleged against the petitioner, this Court is not inclined to grant anticipatory bail to him. Accordingly, the Criminal Petition is dismissed. ______________ RAJA ELANGO, J November 06, 2015.
