HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.35926 of 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a direction to the respondents to consider the representation of the petitioner dated 30.1.2016 and to settle the policy amount of the petitioner.

Heard and perused the material available on record. 3.

It is the grievance of the petitioner that on 27.9.2010, she took a pension policy from the 3rd respondent and she agreed to pay ten years premium and accordingly, she paid the premiums for five years and till now, she paid Rs.1,50,000/- to the 3rd respondent. As the husband of the petitioner fell sick, she submitted a representation to the respondents on 30.1.2016 surrendering her policy and seeking to pay back the amount as per the norms of the respondents. But the respondents have not considered her representation so far.

Considering the circumstances of the case and the grievance of the petitioner, without expressing any opinion on merits, the Writ Petition is disposed of with the following direction:

"The respondents are directed to consider the representation of the petitioner and dispose of the same, within a period of one month from the date of receipt of a copy of this order, as her representation is based on medical grounds." There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
