THE HON'BLE DR. JUSTICE B.SIVA SANKARA RAO WRIT PETITION No.24621 of 2013 ORDER:

This writ petition is filed by the petitioner to declare the order dated 07.08.2013 issued by the 3rd respondent insisting for production of no objection certificate from the 4th respondent panchayat for implementation of the layouts at S.No.211/2 as illegal, arbitrary and unconstitutional.

2) Heard both sides and perused the material on record.

3) The 3rd respondent filed counter stating that the petitioner is using the domestic service connection for lighting of the lay out in Sy.No.211/2 in an extent of Ac.2.72 cents and the said usage is against the terms and conditions for providing domestic connection. It is submitted by the learned counsel for the respondent during the course of arguments that one of the mandatory requirements is DTCP approval shall be made besides lay out must be approved with necessary DTR apart from no objection certificate from the 4th respondent-gram panchayat.

4) Having regard to the above, the writ petition is dismissed giving liberty to the petitioner to make an application before competent authority for approval and if no consideration is made within one month, thereafter, subject to showing the compliance, the petitioner is given liberty to file a fresh petition. No costs. Consequently, miscellaneous petitions, if any shall stand closed.
