THE HON'BLE SRI JUSTICE SANJAY KUMAR CONTEMPT CASE NO.2359 OF 2016
O R D E R
This contempt case was instituted alleging wilful disobedience to the order dated 04.02.2016 passed by this Court in W.P.M.P.No.4196 of 2016 in W.P.No.3294 of 2016. By the said order, this Court took note of the material filed by the petitioner in evidence of his possession and directed the respondent authorities not to evict him from the subject property except in accordance with the due procedure prescribed by law.
The complaint of the petitioner is that the authorities sent the Mandal Parishad Officer and Mandal Revenue Officer to his land and threatened him.
The Executive Engineer (R&B) Division, Dharmavaram, respondent No.1, and the Deputy Executive Engineer, (R&B) SubDivision, Kadiri, respondent No.2, filed individual counter affidavits denying the allegations levelled by the petitioner. They stated in one voice that no steps had been taken to interfere with the possession and enjoyment of the petitioner over the subject property without following the due procedure laid down by law, as alleged. Though these counter affidavits were filed as long back as in December, 2016, the petitioner did not choose to rebut the averments made therein by filing a reply.
In that view of the matter, no cause is made out to draw an inference that the authorities are trying to interfere with the petitioner's possession in violation of the due procedure laid down by law as mandated by this Court.
The contempt case is accordingly dismissed. No order as to costs.
