THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.37803 of 2015 ORDER:
The grievance of the petitioners was with regard to the investigation by the police authorities of Neredmet police station in Crime No.78 of 2015 registered on the file of the said police station under Sections 324, 354, 357, 420, 494, 506 and 509 I.P.C. The petitioners sought a direction for transfer of the investigation in the said crime to any other police station or other special investigation team.
The Station House Officer, Neredmet Police Station, Cyberabad, furnished written instructions dated 07.12.2015 to the office of the learned Government Pleader for Home, wherein he stated that upon due investigation, the police authorities found that no cognizable case was made out for taking further action and accordingly a final report referring the case as 'false' was filed under Section 173(2) Cr.P.C. before the learned XX Metropolitan Magistrate at Malkajgiri, Cyberabad, after service of notice upon the complainants. A copy of the final report is also placed on record. In the light of the afore-stated developments, it is for the petitioners to take recourse to appropriate remedies in accordance with law in the event they are aggrieved by the conclusion arrived at by the police authorities. Reserving liberty to the petitioners to do so, the writ petition is closed. Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
