HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 35311 of 2018 ORDER:

1) Heard learned counsel for the petitioners and learned Government Pleader for Revenue. With the consent of both the parties, the writ petition is disposed of at the admission stage itself.

2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the inaction of respondent Nos.2 to 4 in mutating the names of the petitioners in revenue records and not issuing pattadar pass books and title deeds, in favour of the petitioners, in respect of the lands admeasuring Acs.2.50 cents in Survey No.206/4, Acs.2.50 cents in Survey No.205/2 and Acs.2.00 in Survey No.204/3, situated at Uchaguntapalem village, Dagadarthi mandal, SPSR Nellore district, as illegal and arbitrary.

3) Learned counsel for the petitioners mainly submits that the petitioners herein purchased the lands referred to above from the ex-service men, under a registered sale deed, during the years 1984 and 1985. Ever since the date of purchase, the petitioners claim to be in possession of the said lands. The sale transactions were also effected in the certificate issued by the Sub-Registrar. While things stood thus, the petitioners made an application, for mutation of their names in the revenue records. It is stated that the authorities have not acted on the said

representation, for reasons best known to them. It is stated that a complaint was also made by the father of the petitioners, before the Hon'ble Lokayukta, seeking direction to the concerned authorities for issuance of pattadar pass books and title deeds. Accordingly, the Hon'ble Lokayukta directed the revenue authorities to issue pattadar pass books and title deeds in favour of the father of the petitioners. Inspite of the said orders and making several representations, the authorities did not issue pattadar pass book and title deed, till date. Hence, the present writ petition came to be filed.

4) Learned Government Pleader for revenue would submit that the petitioners may be directed to make fresh online application in Form-VI A, in which event, the same shall be dealt with, in accordance with law.

5) Recording the said submission, the writ petition is disposed of directing the petitioners to make fresh online application in Form VI A, enclosing necessary documents, in which event, the authorities shall deal with the same, in accordance with law, as early as possible, preferably within a period of two (02) months from the date of receipt of the application.

6) Miscellaneous petitions, pending if any, shall stand closed in the light of this final order. No order as to costs. _______________________________ JUSTICE C. PRAVEEN KUMAR 01.10.2018 vhb
